Right of withdrawal
Information on exercising the right of withdrawal for consumers
The right of withdrawal (the right to withdraw from the contract) for orders placed at a distance applies exclusively to consumers within the meaning of § 1 KSchG – people who do not use doclarity for a commercial or independent professional activity. Businesses and public bodies have no right of withdrawal.
1. Right of withdrawal
If you are a consumer within the meaning of the Austrian Consumer Protection Act, you have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us –

Email: doclarity@klartext-ai.com
Phone: +43 660 81010 67
– of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post, or an email). You may use the model withdrawal form below, but you are not required to. You can also use the “Withdraw from contract” button in your account, in the billing area.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
2. Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In no event will you be charged any fees as a result of such reimbursement.
If you requested that the doclarity services begin during the withdrawal period and you have used them, you must pay us a reasonable amount corresponding to the proportion of the services already supplied up to the point at which you inform us of the exercise of your right of withdrawal in respect of this contract, compared with the full scope of the services provided for in the contract. That proportion is measured by the number of pages counted towards your quota up to that point, in relation to the pages included in your plan or package. Pages count towards your quota only when a finished document is downloaded (terms and conditions, § 5(3)).
3. Early start of performance and expiry of the right of withdrawal
doclarity is a digital service. We begin performance before the fourteen-day withdrawal period has expired only if you
- expressly request it, and
- confirm that you have taken note that you lose your right of withdrawal once the contract has been fully performed.
We obtain both declarations when you place your order, in a separate field that is not pre-ticked and that is separate from your acceptance of the terms and conditions, and we confirm them to you on a durable medium (for example by email).
If you do not make these declarations, we do not begin performance early. The service then starts automatically on the day after the withdrawal period ends; you do not need to do anything. For a rate, you only store your payment method when you order; the first charge is made on that day, and the term begins on that day. A page package or migration package is paid for when you order; it is usable from that day, and its validity period runs from the date of purchase.
In the case of services, the right of withdrawal expires once we have fully performed the service, after you expressly requested that we begin performance before the withdrawal period expired and you confirmed your awareness that you lose your right of withdrawal once the contract has been fully performed.
4. Free plan and private access
The free plan and private access are free of charge. No right of withdrawal under the Distance and Off-Premises Contracts Act (FAGG) arises from them. You can delete your account at any time and with no notice period, or ask us to delete it; that ends your use of the service.
5. Model withdrawal form
You can declare your withdrawal in any way you like: most simply with the “Withdraw from contract” button in your account, or informally by email, or using the model withdrawal form below, which you are not required to use. We will confirm receipt of your withdrawal by email without delay, stating the content of your declaration and the date and time it reached us.
